2. Eligibility
You must be at least 18 years of age to place an order on this Website. By placing an order, you confirm that you are 18 or older, or that you have the consent of a parent or guardian.
3. Products
3.1 All products sold on this Website are botanical skincare products formulated and made in Malaysia by Home Apothecary Sdn Bhd.
3.2 Our products are cosmetic products. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Please refer to our Product Disclaimer before purchase.
3.3 Product images are for illustration. As our products are made with natural botanical ingredients through a slow infusion process, minor variations in colour, scent, and texture between batches are normal and do not constitute a defect.
3.4 Full ingredient lists are published on each product page. You are responsible for reviewing the ingredient list before purchase if you have known allergies or sensitivities. We recommend a patch test before first use of any new skincare product.
4. Prices & Payment
4.1 All prices are displayed in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise. Shipping fees, where applicable, are displayed at checkout before payment.
4.2 Payment is processed securely by HitPay, our third-party payment gateway. We accept FPX online banking, DuitNow, GrabPay, and Touch 'n Go eWallet. We do not store your full banking or card details on our servers.
4.3 We reserve the right to correct pricing errors. If a product is listed at an incorrect price due to a typographical or system error, we may cancel the order and issue a full refund, and we will notify you before doing so.
4.4 Promotional codes are single-use, bound to the email address they were issued to, and subject to stated expiry dates. Codes that are expired, already redeemed, or used with a non-matching email will be rejected at checkout.
5. Orders & Order Acceptance
5.1 Your order constitutes an offer to purchase. An order is accepted only when payment is successfully confirmed by our payment gateway and you receive an order confirmation email.
5.2 Stock is reserved for 30 minutes once checkout begins. If payment is not completed within that window, the order is automatically cancelled and stock is released.
5.3 We may decline or cancel an order where: stock is unavailable; a pricing or product description error occurred; payment cannot be verified; or we reasonably suspect fraud or abuse of promotional codes. In all such cases, any amount paid will be refunded in full.
6. Shipping & Delivery

7. Cancellations, Returns & Refunds
Our Cancellation & Refund Policy forms part of these Terms. In summary: for hygiene and safety reasons, opened or used skincare products cannot be returned except where the product is defective, damaged in transit, or incorrectly supplied. Nothing in that policy limits your rights under the Consumer Protection Act 1999.
8. Consumer Guarantees
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Consumer Protection Act 1999 or other applicable Malaysian law, including guarantees that goods are of acceptable quality, fit for purpose, and match their description.
9. Intellectual Property
All content on this Website — including the homeApothec name and logo, product names, formulations, copy, photographs, and videos — is owned by or licensed to Home Apothecary Sdn Bhd. You may not reproduce, distribute, or use any content for commercial purposes without our prior written consent.
10. Acceptable Use
You agree not to: use the Website for any unlawful purpose; attempt to gain unauthorised access to our systems or customer data; scrape or harvest data from the Website; submit false reviews or fraudulent orders; or interfere with the proper operation of the Website.
11. Reviews & Customer Content
By submitting a review, photo, or testimonial to us (including via WhatsApp or email), you grant Home Apothecary Sdn Bhd a non-exclusive, royalty-free licence to use that content on our Website and marketing channels. We will not publish your full name or personal contact details without consent. You may request removal of your content at any time by contacting us.
12. Limitation of Liability
12.1 To the fullest extent permitted by Malaysian law, our total liability arising from any order is limited to the amount you paid for that order.
12.2 We are not liable for indirect or consequential losses, or for delays and failures caused by events beyond our reasonable control (including courier delays, natural disasters, or payment network outages).
12.3 Nothing in this clause limits liability that cannot be excluded under Malaysian law, including liability under the Consumer Protection Act 1999.

These Terms are governed by the laws of Malaysia. Any dispute shall be subject to the non-exclusive jurisdiction of the courts of Malaysia. Consumers may also refer eligible claims to the Tribunal for Consumer Claims Malaysia (TTPM) for claims up to the prescribed limit.
